Legal Framework

ADNET is a trademark under which various companies operate, each of which is a separate and distinct legal entity. Each of these companies promotes a high level of responsible behavior in connection with the use of ADNET services and respect the intellectual property rights of others and requires that users of ADNET services do the same. The various ADNET companies have therefore each adopted a stringent policy to which all respective ADNET customers must adhere, and which ensures rights holders can enforce their rights effectively. The ADNET companies are not aware of every different use of their services customers, or a customer’s end users make, nor can these ADNET companies verify what content is available or stored on ADNET servers. If you have identified that a customer is using a ADNET company’s services in violation of that company’s policies, your rights, or any applicable law, please submit an abuse notification to the appropriate ADNET company. Each of the countries in which the respective ADNET companies are located, has its own legal framework in place for processing abuse notifications. Each ADNET company will process abuse notifications it receives in accordance with the requirements of the legal framework of the country in which it is established. Below you will find general information on the abuse handling processes and frameworks for each ADNET company.

ADNET Netherlands B.V.

ADNET Netherlands B.V. is a founding member of the Dutch Notice and Takedown procedure, an agreement between the content industry, the Dutch ministry of justice and the internet industry. ADNET Netherlands B.V. handles abuse notifications according to this procedure. You can download the Dutch Notice and Takedown Procedure here. As a general rule, the Dutch Notice and Takedown Procedure requires the notifier to send a notice to the content provider first. The content provider is the person, body or organization that has placed certain content on the Internet or that is responsible for the space on the Internet of which a third party is able to make use (a forum, for example). If the content provider is unknown, or if it does not respond to the abuse notification, you can then submit a notifications with ADNET Netherlands B.V.

ADNET USA, Inc.

ADNET USA, Inc. will process all abuse notifications it receives in accordance with the requirements of the legal framework of USA, and in particular the Digital Millennium Copyright Act (“DMCA”) for copyright infringement. You may submit an abuse notification to ADNET USA, Inc., by sending an email to abuse@us.leaseweb.com or by filling out this  online form. For copyright infringement, you may also send the notification to ADNET USA, Inc.’s copyright agent.

ADNET CDN B.V.

ADNET CDN B.V. provides a content delivery network that delivers automatic caching services for providers to improve their speed in offering content. ADNET CDN B.V. only acts as a conduit, and does not itself host any information, and as such is not able to remove content. If you submit a notice in accordance with the applicable ADNET CDN B.V. policies, ADNET CDN will forward it to the appropriate provider. You may submit such abuse notification to ADNET CDN B.V., by sending an email to abuse@cdn.leaseweb.com. For copyright infringement, you may also send the notification to ADNET CDN B.V.’s copyright agent.

Should you believe that a ADNET Deutschland GmbH customer is infringing upon your rights or violating ADNET Deutschland GmbH’s acceptable use policies, please send a notice containing at least the location of such infringing content, files and/or any other material to help ADNET Deutschland GmbH determine whether or not such infringing content, files and/or any other material is stored and/or published by using the services of ADNET Deutschland GmbH.
